Terms of Business
Loss Assessing Solutions Limited (“LAS”, “we”, “us”, or “our”)
These Terms of Business set out the basis on which LAS will provide loss assessing services to you, our client. They also outline our regulatory obligations, statutory duties, and the respective responsibilities of both parties.
1. Authorisation and Regulation
LAS is authorised and regulated by the Central Bank of Ireland to act as a Loss Assessor under the European Union (Insurance Distribution) Regulations 2018 (which replaced the Insurance Mediation Regulations 2005).

2. Statutory Codes
We comply with the following codes and standards issued by the Central Bank of Ireland:
- Consumer Protection Code 2012
- Minimum Competency Code 2017 (updated from 2011)
- Fitness and Probity Standards 2014

3. Services Provided
As independent Loss Assessors, we act solely in the interests of the insured. Our services typically include:
- Inspecting the insured premises and assessing the extent of damage;
- Reviewing your insurance policy and advising on cover;
- Preparing and submitting claims to insurers;
- Negotiating with the insurer’s Loss Adjuster;
- Compiling supporting documentation;
- Advising on and, with your agreement, accepting or rejecting settlement offers.
We do not provide advice outside the scope of insurance claim assessment.
4. Client Instructions and Communication
We prefer instructions in writing to minimise misunderstandings. Oral instructions will be accepted if confirmed in writing. Advice will normally be provided in writing; if given orally, it will be recorded. Once we have acted on your instructions, we are not obliged to provide further ongoing advice unless specifically agreed.
5. Cancellation / Cooling-Off Rights
- You may cancel this agreement at any time by giving written notice. Reasonable charges for costs incurred prior to cancellation will apply.
- LAS may terminate this agreement by giving you two weeks’ written notice to your last known address.
6. Remuneration and Fees
The Company is remunerated by a professional fee for work, activity and time spent in providing the best terms, advice, and services for your particular needs.
Our professional fee is based on a percentage of the final settlement achieved plus VAT (currently 23%).
This percentage is agreed with you at the outset and set out in our written client agreement.
We may use subcontractors for technical matters, but all regulated insurance advice will only be provided by LAS employees who meet Central Bank competency requirements.
- If an alternative fee arrangement applies, it will be agreed in advance and confirmed in writing.
- Where claims are complex or require specialist input, fees may be adjusted. Any change will be discussed and agreed before further work is carried out.
- Fees are payable directly to LAS within 10 days of issue of the insurer’s settlement cheque.
- If specialist subcontractors are required (e.g. surveyors, engineers), their fees are payable directly by you, in addition to our fees.
7. Default and Interest on Late Payments
If payment is not made when due, LAS reserves the right to charge interest at 1.5% per week on outstanding balances. We may also pursue legal remedies for recovery of unpaid fees.
8. Complaints Procedure
We maintain a written complaints procedure in line with Central Bank requirements.
We will acknowledge complaints within 5 business days.
We will provide written updates every 20 business days.
A final response will be issued within 40 business days.

9. Conflicts of Interest
We seek to avoid conflicts of interest. Where a conflict arises, we will disclose it to you and outline the measures we will take to protect your interests.
10. Data Protection
We comply with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR).
- Personal data is collected only for legitimate business purposes and to provide our services.
- Data may be shared with professional third parties where necessary (e.g., surveyors, contractors).
- You have the right to access your personal data, request rectification, and request erasure, subject to legal requirements.

11. Anti-Money Laundering
We may request proof of identity, proof of address, and other documentation where required under Anti-Money Laundering (AML) legislation.
12. Duty of Disclosure
You must provide complete and accurate information when making a claim. Failure to disclose material information may result in your insurer reducing or rejecting your claim. Fraudulent, exaggerated, or misleading information may result in the policy being voided.
13. Recording of Calls
Telephone calls may be recorded for training, quality control, and regulatory compliance.
14. Force Majeure
We shall not be liable for failure or delay in performing our obligations where such failure is due to events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, epidemics, or government restrictions.
15. Governing Law and Jurisdiction
These Terms of Business are governed by Irish law. Any disputes shall be subject to the exclusive jurisdiction of the Courts of Ireland.
16. General Provisions
Severability: If any provision is found unenforceable, the remaining provisions shall continue in full force.
Entire Agreement: These Terms, together with your signed client agreement, constitute the entire agreement between us.
Variation: Any amendment to these Terms must be agreed in writing by both parties.
Waiver: Delay or failure to exercise any right shall not constitute a waiver of that right.
